It is very good advice. Perhaps I understand how we make our living and you do not. The Lis Penden bit is over the line into practicing law...for which you are not qualified Steve. It is also an escalation that opens the Broker up to damages that would not otherwise be possible. It is the sort of mechanism used only in very unusual cases and may not work at all in some States. It may also make out very well for the seller...particularly in a rising market. I have, on occassion, pressed a legal department to pursue an absolutely upright position against another agent or his client.. Unless it is a whole lot of money and an absolute win they will not. There position is quite simple...the possibility of losing is simply too great to deal with. And in a number of ways we qualify as the oldest profession. Ever come across a listing agent who promises the world...signs the client...puts it |
