Caveat Emptor does not apply to Real Estate. A Realtor's fiduciary responsibility is to diclose any "external obsolescences" to the property, as well as anything about the real property itself. Example: If the Realtor knows that a railroad track is going to be implemented close to the home in X amount of time, the railroad is an external obsolescence and should be disclosed. Example: If the neighborhood of this particular subject home is publicly known to have an unusual rate of crime, etc. the Realtor has fiduciary responsibility to disclose this to any potential buyers. Example: If the people next door are publicly known for disturbing the peace, it is the Realtor's fiduciary responsibility to disclose.
