Just because something is legal does not mean you have to do it. The law is designed to let people know where the line of "too far" is concerning abusive practices. Any clear thinking person understands a fiduciary relationship is in the customer or client's best interest. To operate in that position because "we are allowed to by law" is not a decision based on ethics, conscience, or any kind of moral strength of character, but rather by the huckster con-man mentality of "it is not illegal, so I'll do it even if it is not right." By taking the easy way out and not challenging this, and demanding its members give sellers and buyers proper representation that demands the highest commitment from member brokers and agents - just because it is allowed by law FAR has cheapened the whole real estate industry in Florida.
