My condo isn't a condo

I put a deposit down on a condo about 6 weeks ago. I am buying from a development company. I have a closing date scheduled for 8/31. On Friday, I received a call from my mortgage broker. It seems that the appraiser couldn't do the appraisal as ordered because the condo is legally registered with the county government as an apartment. The paperwork required to convert the unit to a condo has not been processed yet. It is "supposed to" be processed next week. If the paperwork is completed next week, then I can close on 8/31. If it is not completed, then I cannot close on 8/31, and I will incur additional fees on my mortgage. If it sits in the government office long enough, then I will not have a home at all. My future homelessness rests in the hands of some government official. What should I do? I don't want to nix the deal. I don't want to take anyone to court, if that would even be possible.
