renting out room legal question

Hello, My roommate has been renting out a room of my house for the past 3 years. As I knew this person prior to renting out the room I did not collect a security deposit nor did I make him/her sign a rental agreement / lease. The other day while talking to a friend I mentioned this and they mentioned how dangerous that could be to me. I asked why, and they said that if I ever wanted them to leave that legally I would have to give them a certain amount of notice or THEY could take ME to court. Is that true? I was under the impression that as the title to the house is in my name I have the legal authority to kick anybody out without having to provide advance notice. Although I couldnt imagine that ever happening what if a situation were to occur where I no longer want this person in my house? Thanks! -Giles . |
