Vertical crack - subsidence or not?

Our property has had subsidence, which, according to the insurance
company was due to a tree too close to the house. The work is covered by
insurance. They accept the tree caused subsidence.
However, there is one fine vertical crack that goes from the top of the
house to the bottom of the house, on the opposite side to the tree,
which is visible on both the inside and the outside. This the
surveyor/structural engineer (sorry I don't know what his background is)
says this is due to differential thermal expansion, and not subsidence
and hence not covered by insurance. He bases this on the fact the crack
is almost vertical and there was recently a hot summer.
The company doing the repair work disagree, although they are telling me
this not wishing to be quoted on it.
All cracks appeared at the same time, following a hot summer. I live in
Essex, UK and are on a clay soil. The house is 1853 and is detached, two
story, 3 bedrooms.
