To enter the US without this aggro you have to answer "No" to a question that says "have you ever been arrested (for anything)". Arrested!, not convicted, not charged, but simply arrested. Even if it was all a mistaken ID you still have to go to the Embassy for your interview. You were guilty, if the rules say that a convicted person has to have an interview, then that is the rule.
