Copyright law treats published and unpublished works differently. Published copies of manuscripts and paintings have copyrights that expire at the usual period, so if you want to reproduce a print of the Mona Lisa you can do so 70 years after the photographer who took it is dead. (A copy that old would probably not be worth reproducing). But you can't make a *new* copy from the original without consent from whoever owns the rights - this may not be the same person or institution as the owner of the MS or picture itself, though for most of the Louvre's stuff it probably is. I've been through this one over permissions to publish an 18th century manuscript; I'm not guessing. For that MS, the owners of the rights were untraceable - I'm one of the very few people |
