This could be a very sticky situation. It is not usually a simple thing just to "take someone off the title". If the ex-wife is on the title, then she is technically an owner of the property as well as the husband. And she is also probably on the mortgage too. I am sure that if the ex-wife agreed, there are legal ways to get her off the title, and if the husband refinanced on his own that would take care of her participation in the original mortgage. But I wonder why all this wasn't worked out when the divorce occured? At any rate the husband should consult an attorney. (I am not an attorney, but a Realtor) Darren . |
